1. Purpose
This Liability Waiver applies to your use of the My Equine Pro website and to any service, appointment, or activity you arrange through a professional found on it, including services involving horses and other animals.
2. Inherent risks
Work with horses and animals involves inherent risks, including unpredictable animal behaviour, kicks, bites, trampling, falls, collisions, fear or panic reactions, transport hazards, hazards in barns, stalls, pastures, and grounds, weather, illness or injury, and interactions with other people and animals.
3. Our role
My Equine Pro LLC publishes profiles and connects independent users and professionals. My Equine Pro LLC does not provide, supervise, or control any professional service, and is not a party to any agreement between a professional and a user.
4. No inspection or guarantee
My Equine Pro LLC does not inspect, certify, evaluate, or guarantee: the qualifications, experience, licences, certifications, or insurance of any professional; the quality or safety of any service; the accuracy of any profile or listing; or the health, temperament, or behaviour of any animal.
5. Professionals' responsibility
Each professional is responsible for holding every licence, permit, certification, and insurance that their work requires, for performing services with appropriate care, and for complying with applicable laws and safety rules.
6. Your responsibility
You are responsible for checking the qualifications, licences, insurance, and references of any professional before hiring them, for confirming prices, dates, and terms, and for making sure you have appropriate insurance for your horses and other animals.
7. Assumption of risk
By using the website or hiring a professional, you knowingly and voluntarily accept the risks described in this waiver, including the inherent risks of working with horses and animals.
8. Emergencies
My Equine Pro LLC does not provide medical, veterinary, rescue, emergency transport, or insurance services. In an emergency, contact the appropriate emergency services.
9. Florida Equine Activity Liability Act
Florida Statutes Chapter 773 (sections 773.01 to 773.06) addresses liability for injuries from the inherent risks of equine activities. Where that law applies to a professional or an activity, the professional must give the warning it requires. Nothing in this waiver removes any protection or obligation that Chapter 773 gives or imposes.
10. Release
To the fullest extent the law allows, you release My Equine Pro LLC, its officers, members, managers, employees, and agents from any claim arising from your use of the website or from any service or activity connected with a professional found on it, including injury, death, property damage, animal injury, theft, financial loss, and disputes between users and professionals.
11. What this waiver does not cover
This waiver does not release My Equine Pro LLC from liability for intentional misconduct, gross negligence, or any obligation that Florida law does not allow to be waived.
12. Acceptance
When you create an account, you must tick the box "I have read and accept the Liability Waiver," then click to accept. We record the version accepted, the date, the time, and your account. Using the website after that confirms your acceptance.
